CONDITIONS OF PURCHASE
these conditions define the procedure of ordering, delivery and returning or claim of merchandise offered on our web-page.

Vendors of merchandise offered on these pages is:

And the buyer of merchandise is the visitor of online shop who chooses at least one article, fills the electronic form for order and sends it to vendors.
All prices are expressed in € (EUR) and include VAT tax.

ORDERING
Ordering of merchandise is possible 24 hours a day, 7 days a week.

PAYING WITH CREDIT CARD ON WEB-SHOP
Ordered articles can be payed easily and safely with one of these credit cards: American Express, Diners, MasterCard, Maestro or Visa. Service of safe Internet-management is provided by T-Com Pay Way.

OTHER WAYS OF PAYING
Payments are also possible by e-banking on account number in Raiffeisenbank HR9624840081100274374 with indication of payment for web-shop. On our e-mail mephisto@koleks.hr you will send the name of model and size that you chose, as well as your address and telephone number.

CONFIRMATION OF ORDER
The buyer will receive notification of confirmation about his order on his e-mail address after the purchase is done and has all details approved by the law.

Since the product stock is updated at the end of the day, it may happen that the product you ordered is not in stock because it has already been sold to another customer during the day.

If the merchandise is not available, the vendors will inform the buyer (by e- mail or telephone call) about possible deadline of delivery. At that point, the buyer can accept the new deadline or cancel the order. If the customer decides to cancel the order- vendors will return the money within 30 days since the delay started, increased by penalties.

DELIVERY

Ordered merchandise will be delivered within:

• EU, Switzerland, Norway, Iceland and other Europe countries: 1-2 days (by DHL)
• USA and Canada: 3-4 days (by DHL)
• Japan, South Korea and Taiwan: 3-4 days (by DHL)
• Croatia: 2 days by GLS

When the customer receiver his order to his address, he is obligated to check the merchandise and establish if there are any damages. If there are damages, customer needs to immediately return the package to deliverer (if there are visible external damages). The merchandise is insured from delivery loss, is if the customer doesn’t receive his order (or isn’t informed by vendors/post office about some kind of delay) within 30 days, customer needs to contact vendors about that, so the vendors can take necessary action to find the package or send replacement.

TAXES AND DUTIES

We ship from EU (European Union). For all destinations in the European Union and the USA (for shipments under 800$) you do not have to pay any taxes. For all other countries the recipient is responsible for all import fees, custom taxes and local taxes imposed by the country where shipment is made. Since we ship to all countries with DHL you can check what could be fees, custom taxes and local taxes with DHL Express https://www.dhl.com/en.html for your country

REFUND
If the model or colour doesn’t fit the customer, there is a possibility of replacement within 7 days. Customer needs to contact web-shop on e-mail: mephisto@koleks.hr about that refund. When the refund is confirmed from our side, customer needs to send the package (on his own expense) to the address: KOLEKS d.o.o., Nodilova 7, 10 000 Zagreb, Croatia. The shoes need to be packed the same way they were received with written request for new size or colour (the same request that was sent by e-mail).Then Koleks d.o.o. web-shop delivers new shoes free of charge in wanted size or colour.

UNILATERAL TERMINATION OF THE CONTRACT
The customer has the right, without giving reasons, to unilaterally terminate the contract concluded outside the business premises or concluded at a distance from the day of its conclusion, and no later than within 14 days from the receipt of the goods.
In order for the customer to be able to exercise the right to unilaterally terminate the Agreement, he must notify Koleks d.o.o. of his decision to unilaterally terminate the Agreement before the expiration of the deadline, by an unequivocal statement sent by post (Koleks d.o.o., Nodilova 7, 10000 Zagreb), or by email to koleks@koleks. hr, in which you will state your first and last name, address, phone number, e-mail address, and you can also use the specified written form for unilateral termination of the Agreement. You can download the form for unilateral termination of the contract here. We will send you the confirmation of receipt of the notice of unilateral termination of the contract by e-mail without delay.

The deadline for unilateral termination of the Agreement is 14 (fourteen) days from the day when the goods that are the subject of the Agreement were handed over to the customer or a third party designated by the customer, who is not the carrier, or, in the case of services, from the conclusion of the Agreement. The buyer is responsible for any decrease in the value of the goods that is the result of handling the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods.

The address for return of goods and delivery of complaints is Koleks d.o.o., Mephisto-shop, 10000 Zagreb, Croatia. Returned Products must be unused, undamaged and in the original packaging with a copy of the invoice attached. The buyer is responsible for any decrease in the value of the goods that is the result of handling the goods, except for that which was necessary to determine the nature, characteristics and functionality of the product.

The seller will return the paid amount of the product, excluding shipping costs, no later than within 10 working days from the day he received the product and the Buyer's decision to terminate the contract. The immediate cost of returning the goods is borne by the Buyer.

LIABILITY FOR MATERIAL DEFECTS

According to the "Act on Obligatory Relations, Art. 400. - 422. regulates the sale of consumer goods and accompanying guarantees'', if you notice a defect or defect in the product, in order to exercise the right to claim responsibility for material defects, you have a period of 2 months from the time you discovered the defect to notify us of the defect . You can claim responsibility for material defects within two years, if you have informed the dealer about the defect within the deadline. If a defect in the product is found within 1 year (365 days) of taking over the purchased product, it is considered that such a defect already existed at the time of purchase. Take care that you must return the object of the complaint in the condition in which you bought it. If you have notified (there must be a written trace) the merchant about the defect in time, you can, at your option:

- Demand from the seller that the defect be removed (within a reasonable period of time),
- Require the seller to hand over another item without defects,
- Declare that you are terminating the purchase agreement

COMPLAINTS
Customer has the right to complaint if there were any damages on the shoes within 7 days. Before sending the shoes back, they need to be cleaned and an e-mail needs to be sent that explains the complaint about the merchandise on e-mail address: webshop@koleks.hr . As well, written explanation needs to be sent with the shoes to address KOLEKS d.o.o., Nodilova 7, 10 000 Zagreb, Croatia, with indication on the package „For WEB-SHOP complaint“. When we receive the shoes, we will check the quality to determine what is the damage and if the repair is possible. Deadline for resolving complaints is 15 working days from the day the package has been received. Manufacturer is not responsible for any mechanical damages that can occur on top or the sole of the shoe by walking, jumping, sliding or similar activities that can damage the shoes.

PRIVACY PROTECTION
Koleks d.o.o. is obligated to protect vulnerable data of its customers, they collect just necessary basic data about customer that they need to carry out our obligations, to inform customer of way we use collected data, give customers possibility of choice about using their data, including possibility of decision if they want or not for their names to be removed from the list that is used for marketing. All data about customers are kept safe and are available only to employees that need them for doing their job. All Koleks d.o.o. employees and business partners are accountable to respect the terms of privacy protection.
